BIOSOFT SPORTS REGISTRATION AND LICENSE AGREEMENT

TERMS AND CONDITIONS:

Use of Biosoft Sports services, softwareapplications (TeamBios, TeamBios 2, TeamBios Pro, Fantasy Bios, Golfer’s
Gold, Fantasy MLB, Bio Calendar and BioCalendar II) and databases are governed by the following
terms and conditions:

The user acknowledges that the information contained in the following web pages are the property of
Biosoft Sports, hereinafter, Biosoft, protected by its copyrights and other proprietary rights. Products
and information are confidential and shall not be reproduced in whole or in part or disclosed to any
third party without the express written consent of Biosoft, except as allowed under the copyright laws
and except that the Customer may produce a single human readable copy of the data for internal,
personal use.

Biosoft is dedicated to high professional standards and strives to provide the best team biorhythm
information and selections possible. However, Biosoft cannot assume any warranty or liability for
damage or loss of any nature incurred by the user with respect to or as a consequence of the use of
Biosoft's sports software programs or selections arising from the use of the software programs.

The sports selections are provided as information only. Although Biosoft has had exceptional
predictability on the outcomes of games during the past 26 years, previous results do not
guarantee similar future outcomes.

NO IMPLIED WARRANTIES:
EACH PARTY (AND THEIR VENDORS) DISCLAIM ALL IMPLIED WARRANTIES,
INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE.

Biosoft shall not be responsible for any delay or failure to perform caused by acts of God,
wars, strikes, natural disasters, failures of network operators' services and interruptions to
power supply.
 
Biosoft reserves the right to terminate the team selection service immediately and without
notice for the following reasons:

If the customer misuses or abuses the service; what constitutes misuse or abuse of the service
shall be solely determined by Biosoft:

If payment for the service is not made timely or cannot be appropriately credited because
inaccurate or improper credit card information is provided to Biosoft Sports or their duly
appointed representatives. These conditions constitute the entire agreement between the user
and Biosoft with regard to the use of Biosoft Sports’ software programs and sports selection
services.

BIOSOFT will make databases and teams available annually for the NFL, NBA, MLB and
PGA if they are readily available via the Internet.
 
For subscription services, BIOSOFT shall create teams and full databases of the NFL and
NBA and make them as current as those available via the Internet.
